Question
Hi Rav, in your answer here (https://www.yeshiva.co/ask/7946) you wrote that "Once the Chametz is sold, if needed you may keep it in your freezer, double bagged or otherwise having made the chametz distinct so that it not be accidentally opened during Pessach" How does that fit in with the halacha that chametz of goy in your property needs to have a mechitza of 10 tefachim?
Answer
ב"ה Shalom, Indeed the Shulchan Aruch writes in Siman 240:b , that there should be a mechitza of 10 Tefachim . This is based upon the Gemara in Pesachim 6a where Rav Yehuda says that if the Chametz of a non-Jew is kept in a Jew's home it needs a mechitza of 10 for the sake of distinction, meaning it serves as a noticeable reminder or marker so that people recognize the separation. Rav Menashe Klein zt"l, discusses this issue at length in his Sefer משנה הלכות חלק ח סי' קפט , and justifies the "minhag haolam" by placing tape and distinguishing that it is Chametz, and not necessarily requiring 10 tefachim, which is basically what I wrote in my answer. See also, הליכות שלמה פרק ו, דבר הלכה י"ב, , סידור פסח כהלכתו , Vol.1, page 250 also suffices by placing a sticker which says Chametz., or by placing tape to close it up , see קנין תורה בהלכה חלק א, סי' ק"י, ,אות ה' אהלי הלכה, פסח פרק ד' עמ' 63. All the Best חג כשר ושמח
