Question
Dear rabbis, Ill iy"H travel with my family this year from chutz laaretz to Israel for sukkot. Weve just moved away from Israel after 5 years. In Israel we kept one day yontev, and in chutz laaretz we would of course keep 2 days yontev. I usually dont mind keeping 2 days, but in Israel it feels strange as there are so few who keep 2 days. In my personal view it seems like a "lezanut" not to do whatever the local custom is. My wife is adamant that I ask a rabbi and dont decide myself, so Im asking if could get a psak to keep one day yontev in Israel (and whenever were un chutz laaretz we would sure keep 2 days). Im looking forward hearing from you.
Answer
ב"ה Shalom, Your wife is right that you ask a Rabbi and not decide for yourself. I think it would be best to ask the Rabbi you both know and hold by in such a situation. Nonetheless, I will present the different views on the matter and then you will mutually have to come to a decision about what to do practically. In The Shulchan Aruch HaRav (of the author of the " tanya" of Chabad) (סי' תצ"ו :יא ) writes that when someone from abroad visits Israel, even if their intention is to return abroad, he keeps only one day in Eretz Yisrael. This is also the opinion on the Chacham Tzvi (סי' קס"ז) and this opinion was also upheld by Rav Goren zt"l. (Torat Hamoadim pg.258). However, the majority of the Rabbis say to keep two days when someone comes with his family from abroad to Eretz Yisrael for Yom tov . (See Mishna Brura 496:13, Birkei Yoseph 496:7) and Piskei Teshuvot 496: 3) . This is not a joking matter, because the holiness of Yom tov is not to be treated lightly especially when these issues involve ,making kiddush, which it the correct Shmone Esre to say for that day, or should one put on Tefillin , after Yom tov is over in Eretz Yisrael and of course there are the issues of desecrating Yom tov, if it is still Yom tov for you. Furthermore, you will see scores of tourists visiting Israel who will have their Yom tov garb on them for the second day of Yom tov. Then on the other hand again, Rav Shlomo Zalaman Oirbach zt"l (Minchat Shlomo 19:7) did say however, that if a person comes with his family for all three of the Yomim tovim, Pesach, Shavuot and Sukkot then he may keep only one day. This is because his presence here for all the "regalim" makes him in regard to this particular mitzvah as if he lived in Israel. This would not apply though, if one were here for only two of the "regalim.". So your decision of how to conduct yourselves over Yom Tov must be seriously considered. חג שמח
