When & How Do Rabbis Issue New Decrees & When Not?!
1. הראי"ה קוק, עין איה שבת ו, יג, על מסכת שבת ס ע"א
באותה שעה אמרו: אל יצא אדם בסנדל המסומר.
א. הפעולה שמאורעות פרטיים פועלים על נפש גדולי העם, המנהיגים אותו בדרך חיים, היא תמיד מכוונת ע"פ עצת ד' העליונה למטרתה התכליתית. אין דבר אחד לבטלה, ואין פעולה מתוארת בצביון פרטי שלא יהא בה לימוד מסודר, כשלוקחים אותו בדרכי אמת והגיון צדק.

ג. ובאותה שעה המוכשרת לכך, בהתגלות הצד המזיק של התוצאות המבהילות, תולדות הדרכה ארוכה שאינה מתוקנת בארחות החיים בכללות האומה, היתה מוכשרת הגזרה להשמע, אל יצא אדם בסנדל המסומר.
2. רמב"ם הלכות שבת פרק יט, הלכה ב
אין יוצאין בסנדל מסומר שסמרו לחזקו, ואפילו ביום טוב גזרו שלא יצא בו, ומותר לצאת באבנט שיש עליו חתיכות קבועות של כסף ושל זהב כמו שהמלכים עושין, מפני שהוא תכשיט וכל שהוא תכשיט מותר, והוא שלא יהא רפוי שמא יפול ברה"ר ויבוא להביאו.
3. ט"ז אורח חיים סימן קפ, (ג)
(פמ"ג) נהגו לכסות הסכין. בב"י ב' טעמים האחד דברזל מקצר ימי האדם ואינו דין שיהיה מונח על השלחן שדומה למזבח שמאריך ימי האדם דע"כ כתיב לא תניף עליהם ברזל. וטעם ב' בשם רבינו שמחה לפי שפעם אחד הגיע אחד לברכת בונה ירושלים ונזכר חורבן הבית ותקע סכין בבטנו ע"כ נהגו לסלקו בשעת ברכה. וכ' ב"י שמה שנוהגין בשבת וי"ט שלא לכסותו לפי טעם רבינו שמחה אין לחלק. ומ"מ מנהגן של ישראל תורה היא עכ"ל. וצריך טעם למה הוקשה לו זה דוקא לטעם רבינו שמחה ולא לטעם האחר ואפשר דקאמר אפי' לטעם ר"ש וכ"ש לטע' הראשון דלר"ש היה אפשר קצת לומר בשבת וי"ט אין האדם מיצר כ"כ ונ"ל דלטע' ר"ש אתי שפיר כי הגזירה שגזרו בזה היה מעין המעשה כדמצינו בשבת שלא יצא אדם בסנדל המסומר משום מעשה שהיה וגזרו דוקא כעין המעשה שנעשה בסנדל מסומר דוקא.
4. רמב"ם הלכות ממרים פרק ב, ה-ו
ה. בית דין שנראה להן לגזור גזירה או לתקן תקנה או להנהיג מנהג צריכין להתיישב בדבר ולידע תחלה אם רוב הצבור יכולין לעמוד בהן או אם אין יכולין לעמוד ולעולם אין גוזרין גזירה על הצבור אלא אם כן רוב הצבור יכולין לעמוד בה.
ו. הרי שגזרו בית דין גזירה ודימו שרוב הקהל יכולין לעמוד בה, ואחר שגזרוה פקפקו העם בה ולא פשטה ברוב הקהל הרי זו בטלה ואינן רשאין לכוף את העם ללכת בה.
