יעקב בן בכורה
"ר"א בשם רבי יוסי בן זמרא (אמר) כל זמן שנמנו ישראל לצורך לא חסרו שלא לצורך חסרו ואי זה זמן נמנו לצורך בימי משה בדגלים ובחילוק הארץ, ושלא לצורך בימי דוד" (במדבר רבה (וילנא) פרשה ב ד"ה יז ד"א והיה).
מדרש זה הועדף גם על ידי הרמב"ן בפירושו לפרשת במדבר וז"ל
"אבל כפי דעתי היה הקצף עליו בעבור שמנאם שלא לצורך, כי לא היה יוצא למלחמה ולא עושה בהם דבר בעת ההיא, רק לשמח לבו שמלך על עם רב, והוא מאמר יואב (ש"ב כד ג) ויוסף ה' אלהיך אל העם כהם וכהם מאה פעמים ואדוני המלך למה חפץ בדבר הזה. וראיתי במדבר סיני רבה (ב יז), ר' אליעזר בשם ר' יוסי בן זמרא אמר, כל זמן שנמנו ישראל לצורך לא חסרו, שלא לצורך חסרו..." (רמב"ן במדבר פרק א פסוק ב).
הרמב"ן איננו מחלק בין דורו של משה, לאחר חטא העגל, לבין הדורות הבאים וגם איננו מזכיר את נושא השקלים בהקשר לטעותו של דוד. לכן נראה לסכם להלכה את שיטת המדרש שהיא כנראה שיטת הרמב"ן להלכה:
א. ספירה חלקית, כלומר מציאת מנינה של קבוצה מסוימת גדולה (כמו במלחמה נגד עמלק בימי שאול) או קטנה (כמו הכהנים שהשתתפו בפיס בכל בוקר), מותרת אם היא לצורך ונעשית באמצעות דבר אחר (כמו טלאים או אגודלים). היתר זה הוא לכל השיטות.
ב. ספירת כל ישראל על ידי מחצית השקל, לפי הבבלי מותרת גם שלא לצורך (טעותו של דוד שלא מנה בשקלים) ולפי המדרש אסורה (שלא לצורך, ובזה טעה דוד).
ג. ספירת כל ישראל לצורך שלא באמצעות מחצית השקל , לפי הבבלי על פי הסבר המהרש"א מותר לדורות. לפי דעת המדרש הדבר לא ברור. (עמוד הימיני סימן יג סע' ט).
נסיים דבריינו השבוע בסיפור מעניין. לפני כמאתיים שנה עם הגיעם של תלמידי הגר"א ארצה בראשות רבי ישראל משקלוב, בעל "פאת השולחן" התקיים דיון הלכתי בעקבות עריכת מפקד אוכלוסין זוטא. ר' צבי הרש לערען המנכ"ל הנמרץ של הפאקו"מ (פקידים ואמרכלים) באמסטרדם, ערך רשימה של מקבלי ההקצבות, והשאלה הגיעה לשולחנו של ה"חתם סופר" שנתבקש להכריע אם הדבר מותר, ומסקנתו הייתה להיתר עיין שו"ת "חתם סופר" (קובץ תשובות תשו' ח).
