סעיף ג - כתובה שאבדה או נמחלה<br />
<br />
במשנה בכתובות (נד, ב) מובאת דעתו של [[רבי מאיר]], שאסור להשהות אשה שאין לה כתובה שכתוב בה הסכום הבסיסי של מאתיים לבתולה ומנה לאלמנה. הגמרא שם מביאה שנפסקה הלכה כמותו, ולא כרבי יהודה הסובר שאשה יכולה למחול. <br />

[[טור]] ו[[שו"ע]]: אסור לשהות שעה אחת עם אשה בלי כתובה. אם הכתובה אבדה או שהאשה כתבה שובר שקיבלה את הכסף - צריך לכתוב כתובה חדשה על עיקר הכתובה (אם היא מחלה. כשהכתובה אבדה צריך לכתוב על הסכום המלא, כולל התוספת - אחרונים ). <br />

⦿ האם יש משמעות למחילה או תנאי של האשה?<br />

◄ [[רמב"ם]] ו[[שו"ע]]: מחילה או תנאי לא תופסים ואפילו בכתב. בכל זאת, אם עשתה תנאי או מחלה בכתב חייב לכתוב כתובה חדשה. אם מחלה בעל פה א"צ כתובה חדשה [ב"ש ועוד. וכתב שכך סובר גם ה[[רמ"א]]].<br />

◄ [[ר"ן]] (בסעיף ט): מחילה או תנאי תופסים אפילו בעל פה (אלא שאסור לו להשהות אותה בלי כתובה, וחייב מיד לכתוב חדשה).<br />

☜ [[רמ"א]]: כשגויים כבשו עיר והכתובות בחזקת אבודות, צריך לכתוב חדשות למרות שיכול להיות שבעתיד ימצאו את הכתובות הישנות. כשכותבים כתובה חדשה צריך לכתוב את אותו הסכום שהיה כתוב בקודמת. אם לא יודעים מה הסכום ואין כתובות שניצלו ואפשר ללמוד מהן את הסכומים - משערים לפי העושר של האדם.<br />

אמנם מכיוון שהיום לא מגרשים ללא הסכמה של האשה לכאורה אין צריך לכתוב כתובה נוספת, אך המנהג לכתוב ואין לשנות.</div>
