[[טור]]: הבא על אשה לשם זנות בלי קידושין לוקה, והיא זונה האמורה בתורה. אפילו אם בא עליה לשם אישות, אם אין שני עדים אינה אשתו וכופין אותו להוציאה.<br />

⤶ מדוע הטור קורא לאשה שבאו עליה בלא קידושין זונה? <br />
הרי ביבמות (סא, ב) נחלקו רבי אליעזר, רבי עקיבא וחכמים מהי זונה, אמנם ר"א סובר שפנוי הבא על פנויה שלא לשם אישות עשאה זונה, אך הלכה כחכמים שרק משוחררת, גיורת והנבעלת לפסול לה נחשבות זונה?<br />
