ב[[תורה]] מפורש שאסור לממזר לבוא בקהל ה' אפילו אחרי עשרה דורות (דברים כג, ג). המשנה ביבמות (עח, ב) כותבת שנתינים (הגבעונים שהתגיירו בעורמה) וממזרים אסורים לעולם, בין הזכרים ובין הנקבות. <br />

טור ושו"ע: ממזרים ונתינים הם פסולי חיתון עד סוף כל הדורות.<br />
<br />
⤶ האם נתינים אסורים מהתורה?<br />
<br />
בנוגע לשבעת העממים התורה מצווה 'לא תחתן בם', ורבא מסיק שהאיסור הוא גם אחרי שהתגיירו (יבמות עו, א). בהמשך הגמרא מובא שיהושע גזר על הנתינים שיהיו אסורים לבוא בקהל, ודוד המשיך את הגזירה לעולם. לכאורה יש סתירה בין הסוגיות כי לדברי רבא אין צורך לגזור עליהם, ונחלקו הראשונים מה מעמד הנתינים מהתורה:<br />

◄ [[רמב"ם]]: מהתורה אחרי הגיור נתינים מותרים לבוא בקהל (הסוגיות חולקות, נפסק כמו הסוגיה השניה והאיסור על הנתינים הוא מדרבנן בלבד).<br />

◄ [[רמב"ן ורשב"א]]: נתין שהתגייר אסור מהתורה, אך בניו אסורים מדרבנן. <br />
<br />
◄ [[ר"ת]] ו[[נימוקי יוסף]]: נתינים אסורים מהתורה לעולם (יהושע ודוד רק גזרו שיהיו עבדים, כי לעניין חיתון התורה כבר אסרה אותם).</div>
