==על מי חלה מיתה זו==<br />
אלו מקרים שבהם קיימת סברה שיש לדון את האדם למיתה, אך התהליך הנדרש לכך ב[[בית דין]] אינו מתקיים מסיבה כל שהיא. למדנו בגמרא:""מי שלקה ושנה ב"ד מכניסין אותו לכיפה ומאכילין אותו שעורין עד שכריסו מתבקעת". ורש"י פירש: '''מי שלקה ושנה''' - שלקה שתי פעמים על שתי עבירות". ובגמרא מבאר שאמנם הוא חטא, אבל טרם הגיע דינו למוות:"'''עדיין לא נתקרבה מיתתו'''. דמוותר נפשיה. דמפקיר עצמו לעבירות: של כרת אחת שעבר אותה עבירה עצמה שלש פעמים על השתים לוקה ובשלישית יכנסוהו לכיפה".<br />

התלמוד מביא דוגמא לגזר דין של מוות בכיפה. אם יש שני עדים המעידין עליו ועדותן אמת. אבל, אין בית הדין יכול לדון אותם למיתה, כמו במקרה ששנים רואין אותו אחד מחלון זה ואחד מחלון זה - כלומר כל אחד ראה את המקרה מזויית שונה. ב[[מסכת מכות]] נאמר: דלא מיקטל עליה ומיהו הכא תנינן דעייל לכיפה אבל על פי עד א' מוציא דבה בעלמא הוא <ref> ו'.ב' </ref>:<br />

או במקרה של '''בעוקצי תאנים''' - בדיקות יתירא הוא ונהי דבן זכאי פטר ליה בההוא הכחשה מקטלא מיהו עדות אמת הוא ועייל לכיפה - דהיינו עד אחד טוען כי הוא ראה את הרצח ליד עץ נושא תאנים קטנות והשני אמר שאלו היו תאנים גדולות. בית הדין לא יכול לפסוק מיתה במקרה זה, אך הוודאות שמדובר ברוצח היא רבה ולכן שמים אותו ב"כיפה".<br />
